Free State High Court Dismisses Dr Nandipha Magudumana’s Application

The Free State High Court in Bloemfontein has dismissed Dr Nandipha Magudumana’s urgent application with costs. Magudumana wanted the court to declare her arrest in Tanzania illegal. She is among the seven people arrested for aiding and abetting murder and rape convict Thabo Bester to escape from prison.

Court Judgment

In his judgment, Judge Phillip Loubser states that Magudumana was clearly aware of the charges she would face during the handover process between the Tanzanian government and South Africa upon her arrival in the country. He also notes that Magudumana did not resist during the handing-over process, as she stated that she wanted to return to South Africa to her children. Loubser claims that Magudumana actively engaged in the handover process. He concludes that if she has any concerns, she should take them up with the Tanzanian government.

Legal Arguments

Last week, the court heard arguments from Magudumana’s legal representative, as well as Home Affairs and South African Police Services legal advocates.

Implications of the Dismissal

The dismissal of Dr Nandipha Magudumana’s application by the Free State High Court in Bloemfontein has significant implications for her legal situation. With the court ruling against her, it means that her arrest in Tanzania is considered legal under South African law. The judgment suggests that Magudumana was aware of the charges against her and willingly participated in the handover process. This decision may impact her future legal options and potential avenues for defense.
